Overview

This website, lumithreads.shop (the "Site"), is operated by Lumorise LLC, doing business as Lumi Threads ("Lumi Threads", "we", "us" or "our"). We offer the Site, including all information, tools and services available on it, to you on the condition that you accept these terms of service ("Terms"), along with the policies referred to here, including our privacy policy, refund policy and shipping policy.

By visiting the Site or buying from us, you agree to these Terms. They apply to all users of the Site, including browsers, customers and anyone who contributes content. If you do not agree to these Terms, please do not use the Site.

Any new features or tools added to the Site are also covered by these Terms. You can review the current version of the Terms on this page at any time.

Our store is hosted on Shopify, which provides the online ecommerce platform that lets us sell our products to you.

Online store terms

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for any minor dependents in your care to use the Site.

You may not use our products or the Site for any illegal or unauthorized purpose, or break any laws in your jurisdiction (including copyright laws) when using the Site. You must not send any worms, viruses or other harmful code. If you break any of these Terms, we may end your access to the Site.

General conditions

We may refuse service to anyone, for any lawful reason, at any time.

Your content (not including payment card information) may be sent unencrypted across networks and may be changed to meet the technical requirements of connecting networks or devices. Payment card information is always encrypted when sent over networks.

You agree not to copy, reproduce, sell, resell or exploit any part of the Site, its content or our designs without our written permission. The designs, text, images and other content on the Site belong to us or our licensors.

Headings in these Terms are for convenience only and do not limit or affect the Terms.

Accuracy, completeness and timeliness of information

We work to keep the information on the Site accurate, but we are not responsible if it is not accurate, complete or current. The material on the Site is for general information only, and you should not rely on it as the only basis for decisions without checking more accurate or complete sources. You rely on the material on the Site at your own risk.

The Site may include historical information that is not current and is provided for reference only. We may change the contents of the Site at any time, but we have no obligation to update any information. It is your responsibility to keep an eye on changes to the Site.

Pricing and changes to the service

Prices for our products may change without notice. A price change does not affect an order that has already been placed and accepted.

We may change or discontinue the Site, or any part of it, at any time without notice. We will not be liable to you or anyone else for any change, price change, suspension or discontinuance of the Site.

Family bundle discount: when you buy 2 to 3 pieces from our Family bundles collection, you get 10% off those pieces, and when you buy 4 or more pieces from that collection, you get 15% off. The discount is applied automatically in the cart. We may change or end this or any other promotion at any time, but changes will not affect orders already placed.

Shipping options and costs, and any applicable taxes, are shown at checkout.

Products

All of our products are printed to order through our production partner, Printify. Because each item is made for you after you order, returns and exchanges are limited as described in our refund policy. Please check our size guide before ordering.

We try to show product colors, designs and details as accurately as we can. However, colors can look different on different screens, and because each item is printed individually, small variations in color and print placement can occur.

We may limit the sale of products to any person, region or jurisdiction on a case-by-case basis. We may limit the quantities of any products we offer, and we may discontinue any product at any time. Product descriptions and prices may change at any time without notice. Any offer for a product made on the Site is void where prohibited.

We do not promise that the quality of any products, information or other material you buy or obtain from us will meet your expectations, or that any errors on the Site will be corrected, except as stated in our refund policy.

Accuracy of billing and account information

We may refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities bought per person, per household or per order. This includes orders placed by or under the same customer account, the same payment method, or orders that use the same billing or shipping address. If we change or cancel an order, we will try to let you know by contacting the email, billing address or phone number you gave when ordering. If we cancel an order you have already paid for, we will refund the amount charged for the cancelled items. We may also limit or prohibit orders that, in our judgment, appear to be placed by dealers, resellers or distributors.

You agree to give current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, payment details and shipping address, so that we can complete your orders and contact you as needed.

Payments are processed by Shopify, including Shopify Payments and Shop Pay, and by any other payment methods shown at checkout. We do not store your full payment card number.

Optional tools

We may give you access to third-party tools that we do not monitor or control. You agree that we provide these tools "as is" and "as available", without any warranties, representations or conditions of any kind and without any endorsement. We have no liability arising from or relating to your use of optional third-party tools.

Any use of optional tools offered through the Site is at your own risk, and you should make sure you are familiar with and approve of the terms on which the relevant third-party providers offer them.

We may also offer new services or features through the Site in the future. These will also be covered by these Terms.

Third-party links

Some content, products and services available through the Site may include materials from third parties. Links on the Site may take you to third-party websites that are not affiliated with us. We are not responsible for checking or evaluating their content or accuracy, and we do not warrant and will not have any liability for any third-party materials, websites, products or services.

We are not liable for any harm or damages related to buying or using goods, services, resources, content or any other transactions made with third-party websites. Please review the third party's policies carefully and make sure you understand them before you take part in any transaction. Complaints, claims, concerns or questions about third-party products should be directed to the third party.

User comments, feedback and other submissions

If you send us comments, ideas, suggestions, reviews or other materials, whether online, by email or otherwise (together, "comments"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use your comments in any medium. We have no obligation to keep comments confidential, to pay you for them, or to respond to them.

We may, but have no obligation to, monitor, edit or remove content that we decide in our sole discretion is unlawful, offensive, threatening, defamatory, pornographic, obscene or otherwise objectionable, or that violates anyone's intellectual property or these Terms.

You agree that your comments will not violate the rights of any third party, including copyright, trademark, privacy, personality or other personal or proprietary rights. You also agree that your comments will not contain unlawful, abusive or obscene material, or any computer virus or other malware that could affect the Site. You may not use a false email address, pretend to be someone else, or otherwise mislead us or others about the origin of any comments. You are solely responsible for any comments you make and their accuracy.

Personal information

Your submission of personal information through the Site is governed by our privacy policy.

We and our service providers, including Shopify, Google and TikTok, use cookies and similar technologies on the Site. We use Google Analytics, including its advertising features, and the TikTok Pixel to measure how the Site is used and how our ads perform, and to show you relevant ads. Our privacy policy explains what information is collected and how you can opt out.

Errors, inaccuracies and omissions

Occasionally there may be information on the Site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, delivery estimates and availability. We may correct any errors, inaccuracies or omissions, and change or update information or cancel orders if any information on the Site is inaccurate, at any time without prior notice (including after you have submitted your order). If we cancel an order for this reason, we will refund any amount charged for the cancelled items.

We have no obligation to update, change or clarify information on the Site, except as required by law.

Prohibited uses

In addition to the other restrictions in these Terms, you may not use the Site or its content:

  • For any unlawful purpose
  • To ask others to perform or take part in any unlawful acts
  • To violate any international, federal, state or local law or regulation
  • To infringe on our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate against anyone
  • To submit false or misleading information
  • To upload or send viruses or any other malicious code
  • To collect or track the personal information of others
  • To spam, phish, pharm, pretext, spider, crawl or scrape
  • For any obscene or immoral purpose
  • To interfere with or get around the security features of the Site or any related website or the internet

We may end your use of the Site for violating any of these prohibited uses.

Disclaimer of warranties and limitation of liability

We do not guarantee, represent or warrant that your use of the Site will be uninterrupted, timely, secure or error-free, or that any results from using the Site will be accurate or reliable. We may remove the Site for periods of time, or cancel it, at any time without notice.

You agree that your use of, or inability to use, the Site is at your own risk. Except as expressly stated by us (including in our refund policy), the Site and all products and services delivered to you through it are provided "as is" and "as available" for your use, without any representation, warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, in no case will Lumi Threads, Lumorise LLC, or our owners, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs or similar damages, arising from your use of the Site or any products bought through it, or for any other claim related in any way to your use of the Site or any product, even if advised of their possibility. Our total liability for any claim related to a product will not exceed the amount you paid for that product.

Some states do not allow the exclusion or limitation of certain warranties or of liability for certain damages. In those states, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend and hold harmless Lumi Threads, Lumorise LLC, and our owners, affiliates, partners, employees, agents, contractors, licensors, service providers, suppliers and interns from any claim or demand, including reasonable attorneys' fees, made by any third party because of or arising out of your breach of these Terms or the documents they refer to, or your violation of any law or the rights of a third party.

Severability

If any part of these Terms is found to be unlawful, void or unenforceable, that part will still be enforced to the fullest extent permitted by law, and the unenforceable portion will be treated as separated from these Terms. This will not affect the validity and enforceability of the remaining provisions.

Termination

The obligations and liabilities of the parties that arose before the termination date will survive termination of this agreement for all purposes.

These Terms are effective unless and until ended by you or us. You may end these Terms at any time by telling us that you no longer wish to use the Site, or by stopping your use of the Site.

If we decide, in our sole judgment, that you have failed, or we suspect that you have failed, to comply with any term or provision of these Terms, we may end this agreement at any time without notice. You will remain responsible for all amounts due up to and including the date of termination, and we may deny you access to the Site or any part of it.

Entire agreement

If we fail to exercise or enforce any right or provision of these Terms, that does not waive the right or provision.

These Terms, and any policies or operating rules posted by us on the Site or relating to the Site, make up the entire agreement and understanding between you and us. They govern your use of the Site and replace any earlier or current agreements, communications and proposals, whether oral or written, between you and us (including any earlier versions of the Terms).

Any unclear wording in these Terms will not be interpreted against the party that drafted them.

Governing law

These Terms, and any separate agreements under which we provide you services, are governed by and interpreted in accordance with the laws of the State of North Carolina, USA, without regard to its conflict of law rules.
